Martin Toledo-Cruz, a 44-year-old Mexican national, is currently held in custody due to an immigration hold.
According to reports from the Miami-Dade County Sheriff’s Office, Toledo-Cruz was taken into custody over the weekend following allegations that he raped a woman at a construction site located in unincorporated Miami-Dade County.
As detailed in the arrest report, the victim stated that she and Toledo-Cruz are acquaintances connected through a mutual friend. She recounted accepting a ride from him on Thursday evening, during which he began to inappropriately touch her over her clothing.
The victim requested that Toledo-Cruz cease his actions; however, he did not comply. He then allegedly drove to an undisclosed construction site, where he parked the vehicle and assaulted her by forcibly removing her leggings and raping her, as per the report.
Despite the victim’s repeated pleas for him to stop, Toledo-Cruz continued his assault. Following the incident, he reportedly took her to a nearby restaurant, where he bought food for her before leaving her near her residence.
Authorities located Toledo-Cruz on Saturday evening, and he reportedly made some form of admission, although specific details of his statement have been redacted from the publicly available report.
Toledo-Cruz now faces charges of sexual battery.
